1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Services").
By creating an account or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services.
2. Eligibility
You must be at least 13 years old to use our Services. To use our monetization features (such as the Wallet for deposits, withdrawals, or purchases), you must be at least 18 years old or the age of legal majority in your jurisdiction. You affirm that you are fully able and competent to enter into and comply with these Terms.
3. User Accounts
- Account Creation: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate.
- Account Security: You are responsible for safeguarding your account password and for any activities or actions under your account. 4. User-Generated Content
- Your Content: You retain ownership of all intellectual property rights in the content you create and post on Takfe, including posts, comments, and media ("User Content").
- License to Takfe: By posting User Content, you grant Takfe a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, host, store, display, reproduce, modify, adapt, publish, and distribute your User Content. This license is for the limited purpose of operating, developing, providing, and improving the Services. This license ends when you delete your User Content or your account.
- Responsibility: You are solely responsible for your User Content and the consequences of posting it. You represent and warrant that you have all the necessary rights to grant us this license and that your User Content does not violate any third-party rights (including copyright) or any applicable laws.
5. Prohibited Conduct
You agree not to do any of the following while using the Services:
- Post or share content that is illegal, fraudulent, defamatory, hateful, harassing, threatening, or promotes violence or self-harm.
- Violate any applicable law or regulation.
- Infringe upon the intellectual property rights of others, including copyright and trademark.
- Engage in spamming, phishing, or sending unsolicited communications.
- Use any robot, spider, or other automated means to access the Services for any purpose without our express written permission.
- Attempt to interfere with the proper working of the Services, compromise the security of the platform, or attempt to gain unauthorized access to any accounts or systems.
- Impersonate another person or entity.
6. Monetization and Financial Terms
Our Services include features that allow creators to earn money and users to support them.
- Wallet: Your Takfe Wallet holds a balance that can be used for transactions within the platform. This balance is not a bank account and is not insured. We may charge fees for deposits and withdrawals, which will be disclosed at the time of the transaction.
- Subscriptions and Purchases: When you subscribe to a creator or purchase a premium post, you are entering into a transaction directly with that creator. Takfe acts as a platform provider to facilitate this transaction.
- Refund Policy: All purchases and subscriptions made on Takfe are final and non-refundable, except where required by law. If you have an issue with a purchase, please contact the creator first.
- For Creators: You are responsible for any taxes owed on the income you earn through Takfe. By enabling monetization, you agree to provide your content to users who have paid for it. We reserve the right to withhold or reverse payments in cases of fraud, violation of these Terms, or chargebacks.
- Post Boosting: You can use funds from your wallet to boost your posts. Boosted posts are a form of advertising and are subject to our content guidelines.
7. Community Moderation
Community creators and moderators are responsible for the content and conduct within their communities. They are expected to enforce their community rules and Takfe's Terms of Use. However, we reserve the right to intervene, remove content, or shut down a community at our discretion if it violates our policies.
8. AI Features
Our platform may use Artificial Intelligence (AI) to generate replies or assist users. You acknowledge that AI-generated content may not always be accurate, complete, or reliable. You should not rely on AI features for professional, financial, or medical advice. You are responsible for any interactions or content generated through your use of AI features.
9. Disclaimers and Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, TAKFE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
IN NO EVENT SHALL TAKFE, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY AND ALL CLAIMS ARISING FROM THE USE OF THE SERVICES IS LIMITED TO THE GREATER OF $100 USD OR THE AMOUNT YOU HAVE PAID US IN THE LAST 12 MONTHS.
10. Governing Law
